TERMS & CONDITIONS

1.1 Provisional Confirmation of Availability and Rates

Upon receipt of a request confirmation of availability, the applicable Villa Seawadee rates and the amount of deposit required will be advised.

Bookings are on a ‘first-come, first-served’ basis and are for a minimum of 2 (two) nights in low and middle seasons and 3 (three) nights in the peak season  to the exception of certain period and unless otherwise specified in the confirmation of availability.

1.2 Exclusions & Additional Charges

Rates do not include baggage handling, gratuities, telephone and mobile phone communications,  car rental, motorbikes, food and soft drinks (excluding drinking water and daily continental breakfast), spirituous liquors, personal items and expenses due to any other third parties, and any excessive cleaning required upon departure (such as upholstery or rug shampooing, etc) or replacement of breakages. Fair wear and tear accepted.

1.3 Rates

Rates include services of a Villa Seawadee representative: one airport shuttle round way per booking, continental breakfast; the cost of electricity, water, wi-fi (not for long-term rent), daily housekeeping, bed linen and bathroom towels changing every third day, beach towels changing on the request;  hair drier, safety box bath rope, slippers. Villa Seawadee is fully equipped with linen, crockery, utensils, and an initial supply of bathroom amenities:  soap, shampoo, hair conditioner, body lotion, ear sticks and shower cap.
In case, if guests with children resist renting Villa Seawadee – we will charge for over capacity.
Maximum Villa Seawadee capacity:
2 bedrooms – 4 adults or children above 12 years old.

3 bedrooms – 6 adults or children above 12 years old.

4 bedrooms – 8 adults or children above 12 years old.
1 infant – baby up to 24 month – per booking can stay free. From the second and more infants will be charged like children from 2 up to 12 years old  – 75 USD or 2520 THB per night
Children after 12 or adults – 105 USD or 3600 THB, per night

1.4 Initial Deposit

An initial deposit of 50%, must be paid to confirm the booking, unless otherwise specified in the confirmation of availability. 

Should be booking be made within 35 days of the arrival the full payment is due upon confirmation and prior arrival.

Before the booking is confirmed and a contract/agreement comes into existence, Villa Seawadee reserves right to increase or decrease the agreed prices. 

No contract/agreement will exist between with Seawadee villa until receipt of funds. If funds are not received within 5 banking day from the receipt of Villa Seawadee invoice, the reservation shall be deemed to have been cancelled and Villa Seawadee reserves the right to allocate the Villa to another client.

The booking of Villa Seawadee is completed, when the deposit is paid; scan/photo Leader Guest passport and filled and signed by Leader Guest Rental Agreement (this form will be taken as a check-in form) will be sent by e-mail to .

1.5 Balance Payment

Transfer of the outstanding  balance must be paid at least 35 days before the day of arrival to Villa Seawadee as provided in the Invoice details by Villa Seawadee at time of booking, unless otherwise specifies in the confirmation of availability.

2. Payments

Payment can be made either international bank transfer, nett of bank fees or via creditcard (Visa or MasterCard).

All bank fees, credit card and transfer fees are the responsibility of the Guest at time of payment. A USD 45 charge is applicable to all bank transfers to cover bank fees incurred during the international transfer process.

If Villa Seawadee does not receive the balance by the due date, Villa Seawadee reserves the right to cancel the booking and cancellation charges will apply.

3. CANCELLATIONS TO RESERVATION

If it becomes necessary to cancel all or any part of the booking, Villa Seawadee must be notified in writing (email acceptable). The cancellation will take effect from the day the written confirmation is received. The following cancellation charges will be payable depending on when the notification of the cancellation is received in writing:

  • More than 30 days before arrival date: The 50% deposit will be forfeited and all other payments will not be refunded. 
  • Less than 30 days before arrival date: all rental payments (100%) are forfeited. 
  • In case the deposit was paid and the balance will not be paid, all payments are forfeited with immediate effect and no notification will be issued.
  • If the dates of the booking need to be changed or amended, this may be treated as a cancellation of the original booking and cancellation charges may apply.
  • Early departure penalty will be applicable as in the other terms for cancellation. Villa Seawadee must be notified in writing (email is accepted). The cancellation will take effect from the day the written confirmation is received. All payments are forfeited.
  • In case of refusal to stay in the villa on arrival day it will be taken as a cancellation . All rental payments (100%) are forfeited.
  • Not arriving to the villa on check-in day will be taken as a cancelation. All rental payments (100%) are forfeited.

Any change to the original reservation is subject to the approval of Villa Seawadee.

4. ARRIVAL & DEPARTURE TIMES

Guests should assume that the check in time is 3:00 pm and check out time is 11.00 am (early arrival and late departure will depend upon availability of the villas at the time of arrival or departure).

The client is responsible for informing the correct arrival details (flight number, arrival/departure time) to Villa Seawadee as advised by Villa Seawadee, whenever an airport transfer is an agreed part of the Villa Seawadee service.

5. ALTERATIONS AND CANCELLATIONS BY VILLA SEAWADEE

Though it is unlikely that Villa Seawadee will have to make any changes to confirmed arrangements, it does occasionally happen, and we will advise you at the earliest possible date. If, for any reason beyond our control, we are unable to provide you with the villa booked, Villa Seawadee shall reserve the right to cancel the reservation. For example, but not inclusive, if the properties are damaged or rendered unusable Villa Seawadee will endeavour to locate the guests to an alternative property for the period required but no guarantee is given that this can

be done.

However, if this is not possible, or guests do not wish to be transferred, Villa Seawadee will cancel the booking and refund in full, less any bank transfer charges, the amount paid to Villa Seawadee.

Villa Seawadee shall not be liable for any further obligations or claims by the client.

6. REGISTERED GUESTS

Please bring photocopies of Leader Guest passport with you. Otherwise the villa manager will check your passports and make the copy.

Only those persons stipulated on the booking form may reside at the property as guests. Please notify us as soon as possible of any changes. The number of people staying at the property must not exceed the maximum capacity 8 persons. Should the owner or a Villa Seawadee local representative find that the number of people staying at the property exceeds that on the booking form; additional guests will be subject to a person per day surcharge 100 USD and/or ask to vacate the property forthwith.

No camping is permitted on the property area.

Villa Seawadee regrets that no pets are allowed on any villa property.

Party organization is subject to negotiation with the owner.

In case a party is to be organized within the property without adjust with owner a extra surcharge of USD 3000 (three thousand USD or equal amount in THB) is applicable. 

7. SECURITY DEPOSIT

A security deposit of US Dollar 1,000 (one thousand) cash will be paid to Villa Seawadee with the payment on Guest arrival. Villa Seawadee will not provide any services until security deposit will be paid. This is to cover the cost of any damage or breakages during the rental period of the Villa. It also can be used in case of lost or damage mobile phone provided by Villa Seawadee. This amount will be returned to the Leader Guest on check-in day and time, less any such costs.

8. INSURANCE

It is a mandatory condition of the booking that the entire party is covered by comprehensive travel insurance (including cancellation, flight delays, loss and damage to baggage and other property) and health insurance (including evacuation and repatriation coverage).

Villa Seawadee owners are held harmless by you and your party against all claims including any accidents related to the use of the Villa facilities or locally procured third party services such as, but not limited to, watercraft, water sports, car or motorbike rental.

Villa Seawadee shall not be responsible for any delay, additional expense or inconvenience caused directly or indirectly by events outside of in- or outside of Villa Seawadee´s control such as civil disturbances, fires, floods, severe weather, Acts of God, acts of Government etc.

By acceptance of this contract/agreement it is assumed by Vila Seawadee that this requirement has and will be complied with in full.

9. LIABILITY

Villa Seawadee is in no circumstances responsible for any loss, expense, damage, claim or injury either directly or indirectly, consequential or otherwise whatsoever, however caused or incurred, whether arising in contract or otherwise in law or equity as a result of rendering of the services or accommodations as described or substituted, or by reason of military action, revolution or acts of God, or by any agents, employees, subcontractors, servants or third parties whatsoever supplying any of the services or accommodations herein or as substituted. If any accommodations and/or services are substituted, Villa Seawadee will act at all times in good faith and use its best efforts to substitute with accommodations and/or services of a type comparable to or better than those originally contracted.

Villa Seawadee at their sole and unfettered discretion reserves the right to refuse or discontinue service to any person(s) and/or to rescind any contract for accommodations or guest services without any explanations.

Villa Seawadee is not responsible for any deaths and injuries whatsoever within or outside its property, e.g. falls from the terrace, staircases or balconies, especially of drunk guests (with alcohol, drugs, etc).

Furthermore Guests are not permitted to enter the property when wet from swimming, as the floors can be slippery. Damager injury arising as result shall not be the responsibility of Villa Seawadee, the owners or the local representative in any way whatsoever.

Villa Seawadee is not responsible for any personal injury or death casualty of adults or children after 12 years old.

For children please, note, that only the parents are solely responsible for the safety of them in the property

By acceptance of this contract and or the transfer of the 50% deposit, the client agrees that this requirement has and will be complied with in full extent.

10. COMPLAINTS

Villa Seawadee does not accept responsibility for the breakdown of the supply of water, or electricity, nor of swimming pool filtration systems, though we will use our best endeavors to arrange for any such problems to be solved quickly.

If there are any problems during the rental period, which could not be solved by dealing directly with the local staff, contact the Owner or Villa Manager will use its best endeavors to rectify the situation. Villa Seawadee will do as much as it can be reasonably expected to avoid and rectify any problems that may occur, but cannot be held responsible for any problems.

Any complaints must be notified to Villa Seawadee within 24 hours of the occurrence giving rise to the complaint.

Should a problem remain unsolved please make an immediate complaint in writing to Villa Seawadee before completion of the rental period. If the Villa is vacated before the end of the rental period without mutual agreement this may result in the loss of all rights to compensation.

The villa may be close to an ongoing construction site.

Villa Seawadee is not responsible and thus not liable for any noise or other disturbance arising out of this. Nonetheless Villa Seawadee will do its best to provide for a nice stay of its guests.

No complaints will be considered if made after the departure date or if not acknowledged by the villa owner or the villa representative.

11. CONDUCT & BEHAVIOUR

The person signing the agreement is responsible for the correct and appropriate behavior of the guests staying at the Villa. Should any member of the party not behave in such a manner, the owner or Villa Seawadee representative may at their absolute discretion ask the offending guest or guests to vacate the Villa forthwith.

All bedrooms in Villa Seawadee – are NON smoking area. Smoking area, only next to infinity swimming pool. It is strictly forbidden to throw away any cigarettes, cigars, lighters or other things, except on devices like ashtrays or waste paper baskets, after having put out the fire with water. It is specially forbidden to throw anything away outside the handrails and balustrades of the terraces or in the garden.
Smoking in bedrooms will be subject to surcharge 500 USD or 18000 THB for 1 time or ask to vacate the property forthwith.

The whole villa is a non-smoking area, except the swimming pool area. It is strictly forbidden to throw away any cigarettes, cigars, lighters or other things, except on devices like ashtrays or waste paper baskets, after having put out the fire with water. It is specially forbidden to throw anything away outside the handrails and balustrades of the terraces or in the garden.

It is not allowed to sit or lie down on any inside villa furniture being wet or having sun screen on the skin (any type of cream or oil), which will be in contact with the furniture.

It is not allowed to jump into the pool, due to the danger of head injuries or other injuries at the low level area and due to slippery feet.

Villa Seawadee  behavior rules do not allow covert or overt discrimination villa staff on sex, race and class lines. Otherwise the Villa reserves the right to ask guests to leave.

In severe cases, this will be treated as a cancellation of the original booking and no refund can be claimed from either Villa Seawadee or the villa owner or the local representative.

12. SOCIAL CORPORATE RESPOSIBILITY

Villa Seawadee’s owner and the local representative endeavour to contribute to the fight against child prostitution and trafficking. Any possible offenders will be brought to the local authorities.

It is also prohibited to act unlawfully in any way whatsoever and to bring in and/or use/consume any illegal substances. Any offenders will be brought to the local authorities.

Prostitution is not allowed in the whole property of Villa Seawadee.

In addition, in line with its moral duty and respect for the local employee, as well as for the safety of our valued guests, it is not authorized to bring male or female joiners met on site back to the properties under no circumstances. The local managers or OWNER reserve the right to request anyone to vacate a property at any time.

13. EXTRA STAFFS AT THE VILLA

Villa Seawadee rates includes 10% service charge and 7%. Including in those services as villa manager, maid and handyman. Extra services such as those of chef, laundry, food delivery, guide, car driver catering for a party, etc can usually be sourced and should be extra paid.

Please make a request as soon as possible – Villa Seawadee will do its best to provide that services.

Villa Seawadee assumes no liability for such contracted staff. The rates for these services will be provided in advance and shall be paid by you as incurred.

14. VALUABLES

Personal safes are provided in Villa Seawadee. It is strongly recommended that they are used to safety box valuable items such as passports, laptop computers, cash, traveler’s cheques, mobile phones, cameras etc. 

Any valuables left at the property are the guest´s sole responsibility. Neither Villa Seawadee owners nor the local representative nor the staff can be hold responsible for any loss or damage of personal property.

To provide the high level of daily cleaning villa staff can touch all your belongings except inside safety boxes and wardrobes

It is advised for Guests to ensure that all doors and windows remain locked at night time to avoid any access.

15. DUE CARE AND SUPERVISION

As part of this agreement guests are required to take care when residing at the villa and be especially watchful of children (above 12 years old) playing, near the entrance of the property, in the staircases, close to the tempered glasses, railing, the pool area and in the pool, in Jacuzzi and Jacuzzi area, all staircases in the villa and at the balconies and terraces.

16. APPLICABLE LAW

These conditions and any contract to which they apply are governed in all respects by Thailand law and the Thailand courts only shall have jurisdiction in relation to any claim or dispute arising out of, or connected with them.

17. AGREEMENT

Villa Seawadee guests have to agree to the above terms and conditions and do hereby agree to the application of the above Terms and Conditions to our reservation upon payment of the booking.
